Lori Vallow Daybell appeals various aspects of her case to Idaho Supreme Court
BOISE, Idaho (CBS2) — Lori Vallow Daybell is appealing nearly 16 aspects of her case up to the Idaho Supreme Court.
Daybell's attorneys are appealing everything from the judgment of conviction to specific instructions given to the jury and several other points. Court documents obtained by CBS2 show that Daybell's attorneys have amended the appeal, adding even more detail and points of clarification for the Idaho Supreme Court to consider.
Several of the specific line items in the court documents speak about Daybell's mental health to stand trial, "Did the court err in its order dated Nov. 15, 2022, wherein the court denied the defense experts' requests to send the defendant back to the mental hospital rather than proceed to trial?"
Other line items surround the defendant's constitutional right to a speedy trial. Lori did not waive her right to a speedy trial, unlike her husband, Chad Daybell, who is expected in court next year.
Lori Vallow Daybell was convicted on three counts of first-degree murder and conspiracy charges about the death of her two children, JJ Vallow and Tylee Ryan, and Chad Daybell's previous wife, Tammy Daybell.
Lori Vallow Daybell is also facing further murder conspiracy charges in Arizona for the death of her former husband, Charles Vallow and the attempted murder of an additional family member who survived. The Governor of Arizona signed extradition paperwork.
